Description of the course The course Conflicts Between Human Rights will focus on methodological perspectives on human rights research as well as on theoretical questions and concrete problems linked to the application of human rights. The course will be multidisciplinary in nature and it will consist of lectures given by international academic human rights experts and of seminars where the participants present papers on theoretical and methodological aspects of their own research projects and receive comments from international experts. The course programme will include a one-day excursion to the archipelago during which there will be both formal sessions and informal discussions on experiences and problems linked to the process of writing a doctoral dissertation.
A part of the lectures by the Faculty members will delve into issues related to various theories of rights that are pertinent for human rights research. This part of the course will combine legal and philosophical perspectives and look into categorizations of rights and theories about hierarchies between rights. It will also focus on analysing “distinction” and “interdependence” as two schools of thought within legal reasoning, the former leading to a conflict-oriented approach and the latter to a harmonizing approach in situations where two human rights appear to compete with each other. A second part of the course looks specifically into the human rights of women, their relationship to human responsibilities, to the collective rights of religious or cultural groups, and to the role of the State. These lectures combine perspectives of philosophy, political theory and law. A third dimension to be covered, through examples, is concrete situations of conflict between specific rights. This part of the course pertains to the field of law and it looks at freedom of expression and environmental protection as two areas where conflicts typically arise.
Credits The course, together with the paper to be written in advance by each participant, corresponds to 5 ECTS or 120 hours of work. The participants will receive a certificate to this effect.
Previous knowledge The participants should be enrolled as doctoral candidates at their home university and should conduct doctoral studies in the field of human rights.
Costs The participation in the course, including travel, accommodation and meals, are provided free of charge due to NorFA funding.
Application The applicant should complete the application form, enclose required documents and send the application to Ms. Maria Sommardahl (see above) by 31 March 2003. The selected participants will be informed of their approval by 15 April 2003 and they should by 15 May 2003 submit a paper (electronically) on one or more theoretical and/or methodological aspects of their ongoing research to be presented and discussed at the course.
